Terms & Conditions

ENTRY INTO THE COMPETITION

1. Entry into the “3D TV" competition (the “Competition”) is open to all permanent residents of Australia over the age of 18 years. The Promoter is Clutch Industries Pty Ltd 13-15 Macquarie Drive Thomastown Vic 3074. ABN 81 101 284 548 (the “Promoter”). Information on how to enter forms part of the terms of entry. Entry into the Competition is deemed acceptance of these terms and conditions.

2. The Competition is a game of chance, and skill plays no part in determining the winner.

3. The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with this Competition related bodies corporate are not eligible to enter.

4. Competition begins at 00:01hrs (AEDT) on 1ST June 2010 and closes at 23:59hrs (AEST) on the 30th September 2010 (the “Competition Period)

5. The winner will be drawn electronically from a database of all entries, which will be conducted at 10.00hrs on 15th October 2010 at Click Creative 314 Punt Rd South Yarra Victoria 3141.

6. All times are stated using the 24-hour clock. 00:01 is the start of the day and 23:59 is the end of the day.

7. To enter the Competition and be eligible to win, entrants who are over the age of 18, must register at Clutch Industries Web Site www.clutchindustries.com.au or text message (SMS) to 1999 1999 Containing:

a. “3DTV” together with

b. your full name and

c. The full Barcode from any Clutch Industries Pty Ltd product

For example: “ 3DTV John Smith 9332854012153 ”

8. SMS entry cost is $0.55c incl GST which is charged by your mobile phone carrier provider. If your mobile phone provider applies a surcharge for sending or receiving a premium SMS, this will be in addition to the $0.55. You will need to check with your provider to determine if there are additional costs.

9. By sending an entry SMS to 1999 1999, you acknowledge that you have read and understood and agree to be bound by these terms and conditions of entry. To be valid, the mobile number from which each SMS is sent must not be withheld and the mobile number must be owned by the entrant.

10. Incomplete and incomprehensible entries or those with defamatory, copyrighted or offensive content will be ineligible.

11. Entrants can enter the Competition as many times as they like.

12. The use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is prohibited. To ensure fairness, the Promoter may undertake automatic and/or manual audits of entries and may deem entries ineligible if it is reasonably believed that they are frivolous, incomprehensible, incomplete, or otherwise not genuine.

13. The SMS entry system is only open to consumers with an SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard.

PRIZE

14. The Prize – 1 x Samsung Series 7 55 inch 3D 200 HZ Full HD Led TV. Prize to be delivered to customer (Please allow up to 28 days from the end of the promotion for delivery)

15. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification No compensation is payable if the winner cannot receive any aspect of the prize for any reason.

16. The total Prize value is $4799.00 (prize values are in Australian dollars). The prize value is correct at time of printing and Clutch Industries Pty Ltd accepts no responsibility for any variation.

17. The Prizes are not transferable or redeemable for cash.

18. All entrants understand that there may be tax or other implications following the award of the Prize and should seek independent advice. All entrants acknowledge that the Promoter may require the Prize winners to (and the Prize winners will) reasonably execute such further documents to limit the Promoter’s liability in relation to the Prize.

19. The Competition is not open to entrants aged under 18 years of age. Any entries from persons under 18 years of age will be deemed ineligible.

WINNER

20. The winner will be notified by telephone on the day of the draw and in writing within 14 days of the draw. The result will be published in the public notices section of the ‘The Australian’ on the 16th October 2010.

21. If the Prize winner cannot be contacted or does not claim the Prize within 3 1/2 months of the draw date, an unclaimed prize draw will be conducted on 17/01/2011 at Click Creative 314 Punt Rd South Yarra Victoria 3141. The result will be published in the public notices section of The Australian Newspaper on 18/1/11. The winner will be notified by telephone and in writing within 14 days of the draw.

GENERAL

22. Programming and other quality control errors will not invalidate an otherwise valid prize claim.

23. All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as a Prize winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that the Prize winner cannot provide suitable proof, the Prize winner will forfeit the Prize in whole and no substitute will be offered.

24. No responsibility will be taken by the Promoter, changes in dates, times or cancellations or other arrangements that may prevent the Prize winners from winning the Prizes.

25. No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promoter’s database and NOT time of transmission by the entrant. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates.

26. A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into.

27. Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law, the Promoter shall not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained as a result of taking the Prize or entering the Competition.

28. All entries become the property of the Promoter and may be communicated to the public by the Promoter or used for promotional purposes, subject to the Promoter’s privacy policy, which is available at www.clutchindustries.com.au. By entering the Competition, the prize winner agrees to the use of their name, image, audio-visual recording and/or photograph/s, without compensation, and agrees that the Promoter will own copyright in any such images, audio-visual recordings and photograph/s.

29. Any cost associated with accessing the Website is the entrants’ responsibility and is dependent on the Internet service provider used. The use of any automated software or any other mechanical or electronic means that allows an entrant to automatically register repeatedly is prohibited and will render all entries submitted by that entrant invalid.

30. If the Competition is not capable of running as planned due to any reason beyond the reasonable control of Clutch Industries Pty Ltd (including, but not limited to fraud, a state of emergency, natural disaster, war, technical failures or any other causes) Clutch Industries Pty Ltd reserves the right without liability to you to cancel, modify, terminate or suspend the Competition, subject to any written directions from a relevant regulatory

authority.

31. If a provision of these terms and conditions is invalid, illegal or unenforceable, then to the extent of the invalidity, illegality or unenforceability, that provision must be ignored

in the interpretation of these terms and conditions. All other provisions of these terms

and conditions remain in full force and effect.
